Peard & Associates is committed to complying with its obligations under the Privacy Act, 1988 and the associated National Privacy Principles ("the NPPs").
This real estate agency is bound by the NPPs either as a consequence of it being an organisation with an annual turnover of more than $3 million or due to the fact that it derives a benefit, service or advantage by the collection or disclosure of information and opinions about individuals whose identity is apparent or can be ascertained.
However, as with all organizations, the NPPs do not apply to personal information of current or former employees contained in employee records when those records are used directly in connection with the employment relationship. Further, it should be noted that some exemptions are contained within the NPPs with respect to matters such as the disclosure of information relating to public health or public safety, the disclosure of information with respect to law enforcement enquiries and the disclosure of information relating to legal proceedings and negotiations.
Personal information held by this real estate agency includes:
(i) Vendor’s information used in the marketing and sale of real estate and businesses
(ii) Sales information from The Valuer Generals Office, Dept of Land Administration (DOLA) The Real Estate Institute of WA (REIWA). Local Government Authorities,
(iii) Any organisation holding a database of property and business statistics and information.
(iv) Information from purchasers and potential purchasers of property and businesses;
(v) Details of properties, owners and tenants to be used in the leasing and management of commercial and residential properties;
(vi) All such information is used in appraising the value of comparable properties and businesses and to assist in the marketing of these properties and businesses;
This real estate agency holds the information referred to above for the purpose of conducting the services it provides to its customers; vendors, purchasers, owners and tenants. This real estate agency collects information to enable it to provide services in connection with the sale or leasing of properties and businesses;
Information collected by the agency is used to provide advice on all real estate and business agency matters to customers and prospective customers. Such information is sometimes used by this agency to deliver services via the internet;
This real estate agency from time to time contracts out services to third parties that may involve the disclosure of personal information.
Privacy Policy
Pursuant to the NPPs, persons are entitled to obtain access to personal information held by this agency regarding them and their property or business, subject to the relevant exemptions contained in the NPPs and the provision of acceptable proof of identity.
This agency will charge a fee for the provision of this information based on the use of the agency’s resources to supply the information requested. Details of these costs can be obtained by contacting the agency’s Privacy Officer.
Any requests for access to personal information must be made in writing and addressed to the Privacy Officer.
The requested information will generally be made available by supplying copies of the relevant documents If the provision of copies of documents is not practical, the agency will make arrangements for the individual concerned to attend at this real estate agency's offices to carry out a physical inspection of the relevant records.
Wherever possible, we will provide copies of documents or access to the relevant information within 14 days of the receipt of the relevant request. In the case of more complex requests we will endeavour to provide access to the information within 30 days of receiving the request.
If a person believes the information held relating to them is incorrect they are entitled to request this agency corrects the erroneous information.
Should this real estate agency believe that it is entitled to refuse a request to access information or to make corrections it will provide written reasons for its decision.
